On 23 April 2026, the Court of Justice of the EU based in Luxembourg gave its opinion in the case Sedrata (C-414/25)
The 2023 protocol between Italy and Albania allows Italy to transfer migrants to detention centres located in Albania.
After their transfer, some asylum seekers challenged their detention, which was rejected by the Rome Court of Appeal as incompatible with EU law.
The case was referred to the Court of Justice of the European Union to determine whether detention in a third country is permitted under EU law.
The Court of Justice of the EU considers that the system may be compatible, provided that the rights of asylum seekers are fully guaranteed.
