On 23 April 2026, the Court of Justice of the EU based in Luxembourg gave its judgment in the case Bank Polska Kasa Opieki (C-744/24).
In Poland, a consumer took out a loan that included credit insurance presented as voluntary.
The bank charged interest not only on the loan amount but also on the insurance premium.
The consumer challenged this practice and requested the removal of the related interest and fees.
He argued that the insurance should not be included in the calculation base for interest.
The national court referred the case to the Court of Justice of the European Union to assess compliance with the EU consumer credit directive.
According to the Court of Justice of the EU, a bank cannot charge interest on amounts used to pay costs linked to the credit.
